Urgent injunction filed over SA govt’s MotoGP development
An injunction application has been lodged in the Federal Court to halt redevelopment works in the Adelaide Park Lands for the upcoming MotoGP.
The state government has confirmed it is aware of an application filed in Federal Court seeking an urgent interim injunction in relation to works associated with MotoGP.
The injunction was lodged by a man named Joshua Hogan on September 18 in the Federal Court of Australia’s Queensland registry.
An urgent interim injunction is a temporary, short-term court order granted quickly to freeze a situation – in this case, construction of the $96 million MotoGP track – until a proper hearing can take place.
The state government said the Crown Solicitor’s Office is currently considering the application.
The state government said it would not comment while the application was still being considered but has confirmed it intends to defend its position through the appropriate court processes.
Further details on the case are not yet public.
It follows public servant Edwin Kemp Attrill’s legal proceedings against South Australia’s Department of Premier and Cabinet in federal court over the controversial North Adelaide golf course development.
Their lawyer, Barrister Arturo Dal Cin of Murray Chambers, argued the North Adelaide Golf Course Act should have been referred to the federal environment minister to test the project against the Commonwealth Environment Protection and Biodiversity Conservation Act 1999.
The state government, represented by lawyer Alison Doecke KC, has argued the project did not meet the threshold for referral to the Federal Environment Minister.
The Federal Court is expected to hand down its final judgement on the case next Thursday, October 1.
